Browsing Case-law: an Application of the Carneades Argumentation System

چکیده
This paper presents an application of the Carneades Argumentation System to case-law. The application relies on a set of ontologies – representing the core and domain concepts of a restricted legal field, the law of contracts – and a collection of precedents taken from Italian courts of different grades. The knowledge base represents the starting point for the construction of rules representing laws and precedents which, in turn, are responsible for the argumentative reasoning. The system reconstructs the legal interpretations performed by the judge, presenting its reasoning path and suggesting possible different or divergent interpretation in the light of relevant codeand case-law.

A Reconstruction using the Carneades Argumentation Framework
The Pierson vs. Post case [1] has become an important benchmark in the field of AI and Law for computational models of argumentation. In [2], BenchCapon used Pierson vs. Post to motivate the use of values and value preferences in his theory-construction account of legal argument. And in a more a recent paper by Atkinson, Bench-Capon and McBurney [3], it was used to illustrate a formalization of...
متن کاملRelating Carneades with Abstract Argumentation
Carneades is a recently proposed formalism for structured argumentation with varying proof standards. An open question is its relation with Dung’s seminal abstract approach to argumentation. In this paper the two formalisms are formally related by translating Carneades into ASPIC, another recently proposed formalism for structured argumentation. Since ASPIC is defined to generate Dungstyle abst...
متن کاملConstructing Legal Arguments with Rules in the Legal Knowledge Interchange Format (LKIF)
The Legal Knowledge Interchange Format (LKIF), being developed in the European ESTRELLA project, defines a knowledge representation language for arguments, rules, ontologies, and cases in XML. In this article, the syntax and argumentation-theoretic semantics of the LKIF rule language is presented and illustrated with an example based on German family law. This example is then applied to show ho...
متن کاملCombining Rules and Ontologies with Carneades
The Carneades software system provides support for constructing, evaluating and visualizing arguments, using formal representations of facts, concepts, defeasible rules and argumentation schemes. This paper illustrates how rules and ontologies can be combined in Carneades with a prototype legal application for analyzing open source software license compatibility issues in particular cases.
متن کاملRelating Carneades with abstract argumentation via the ASPIC+ framework for structured argumentation
Carneades is a recently proposed formalism for structured argumentation with varying proof standards, inspired by legal reasoning but more generally applicable. Its distinctive feature is that each statement can be given its own proof standard, which is claimed to allow a more natural account of reasoning under burden of proof than existing formalisms for structured argumentation, in which proo...
